1. a. No later than six months following the effective date of this act, the Attorney General, in consultation with the Commissioner of Education, shall develop a protocol regarding the retention of video footage from school surveillance systems. Matters to be addressed in the protocol shall include, but need not be limited to, the following: a minimum and maximum amount of time that footage may be retained; measures to be taken to limit access to the footage; and compliance with the “Family Educational Rights and Privacy Act of 1974,” (20 U.S.C. § 1232g). The Attorney General shall review the protocol annually and shall revise it as necessary.
b. Nothing in this act shall be construed to require a school district to install a school surveillance system.
