Terms Used In New Jersey Statutes 30:1AA-1
- Department: means the Department of Human Services. See New Jersey Statutes 30:1-1
- State: extends to and includes any State, territory or possession of the United States, the District of Columbia and the Canal Zone. See New Jersey Statutes 1:1-2
b. For the purpose of complying with the provisions of Article V, Section IV, paragraph 1 of the New Jersey Constitution, the State Council on Developmental Disabilities is hereby allocated within the Department of Human Services, but, notwithstanding said allocation, the council shall be independent of any supervision or control by the department or any board or officer thereof, or any other cabinet-level department, board or officer thereof. The council shall operate in a manner that shall assure compliance with State and federal administrative, fiscal, legislative, procedural and personnel requirements.
c. In addition to the powers and duties herein provided, the State Council on Developmental Disabilities shall constitute the planning entity authorized in the “Developmental Disabilities Assistance and Bill of Rights Act of 2000,” Pub.L.106-402, 42 U.S.C. § 15001 et seq., and shall exercise all the powers and duties as may be necessary to effectuate the purposes and provisions thereof.
