Terms Used In New Jersey Statutes 38:17-2.1

  • person: includes corporations, companies, associations, societies, firms, partnerships and joint stock companies as well as individuals, unless restricted by the context to an individual as distinguished from a corporate entity or specifically restricted to one or some of the above enumerated synonyms and, when used to designate the owner of property which may be the subject of an offense, includes this State, the United States, any other State of the United States as defined infra and any foreign country or government lawfully owning or possessing property within this State. 2. The county medical examiner, or a designee, shall be responsible for the positive identification of an unidentified indigent deceased person. The supervisor of veterans’ interment or county medical examiner, as appropriate, shall contact the Department of Military and Veterans’ Affairs upon receipt of an unclaimed indigent deceased person to ascertain the veteran status of the person. The supervisor of veterans’ interment or county medical examiner, as appropriate, shall be notified upon determination of the veteran status of the person. If the person was a veteran discharged under conditions other than dishonorable, the supervisor of veterans’ interment or county medical examiner, as appropriate, shall cause burial or cremation to occur within 72 hours of notification of veteran status.

For the purposes of this section:

“Indigent” shall mean a person who has an income that is below 200 percent of the federal poverty level; and

“Poverty level” shall mean the official poverty level based on family size established and adjusted under Section 673(2) of Subtitle B. of the federal “Community Services Block Grant Act,” Pub.L.97-35 (42 U.S.C. § 9902(2)).
