- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
12. a. An action under this act is a civil action governed by the Rules Governing the Courts of the State of New Jersey.
b. The trial shall be by the court without a jury.
