Terms Used In New Mexico Statutes 27-6A-3

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Trustee: A person or institution holding and administering property in trust.

B. “utility” means any individual, firm, partnership, company, district, including solid waste district, water and sanitation district and special district, cooperative, association, public or private corporation, lessee, trustee or receiver appointed by any court, municipality and municipal utility as defined in the Municipal Code [3-1-1 N.M. Stat. Ann.], incorporated county or county that may or does own, operate, lease or control any plant, property or facility for:

(1)     the supply, storage, distribution or furnishing of water to or for the public; (2)     the supply and furnishing of sanitary sewer service to or for the public; or

(3)     the supply and furnishing of collection, transportation, treatment or disposal of solid waste to or for the public. “Utility” does not include a public utility subject to the jurisdiction of the public regulation commission.
