A. A petition pursuant to the Uniform Child Abduction Prevention Act may be filed only in a court that has jurisdiction to make a child-custody determination with respect to the child at issue pursuant to the Uniform Child-Custody Jurisdiction and Enforcement Act N.M. Stat. Ann. § 40-10A-101 to 40-10A-403.

- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
B. A court of this state has temporary emergency jurisdiction pursuant to section 40-10A-204 N.M. Stat. Ann. if the court finds a credible risk of abduction.
