The enumeration in Sections 4 [44-6-4 N.M. Stat. Ann.] and 5 [44-6-5 N.M. Stat. Ann.] of the Declaratory Judgment Act does not limit or restrict the exercise of the general powers conferred in Section 2 [44-6-2 N.M. Stat. Ann.], in any proceeding where declaratory relief is sought, in which a judgment or decree will terminate the controversy or remove an uncertainty.
