A. A person that violates Subsection A of Section 58-21-3 N.M. Stat. Ann. for the first offense is guilty of a misdemeanor and upon conviction shall be sentenced pursuant to the provisions of Section 31-19-1 N.M. Stat. Ann..

C. A person that violates Subsection A of Section 58-21-3 N.M. Stat. Ann. for a second or subsequent offense is guilty of a fourth degree felony and upon conviction shall be sentenced pursuant to the provisions of Section 31-18-15 N.M. Stat. Ann..
