New Mexico Statutes 59A-22-1. Scope of article
N.M. Stat. Ann. Chapter 59A, Article 22 applies generally to policies of individual health insurance, including student health plan policies. Nothing in that article shall apply to or affect:
Terms Used In New Mexico Statutes 59A-22-1
- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
- Contract: A legal written agreement that becomes binding when signed.
- insured: as used in this article shall not be construed as preventing a person other than the insured with a proper insurable interest from making application for and owning a policy covering the insured or from being entitled under such a policy to any indemnities, benefits and rights provided therein. See New Mexico Statutes 59A-22-27
A. any policy of workers’ compensation insurance or any policy of liability insurance with or without supplementary expense coverage therein;
B. life insurance, endowment or annuity contracts or contracts supplemental thereto that contain only such provisions relating to health insurance as:
(1) provide additional benefits in case of death by accident; and
(2) operate to safeguard such contracts against lapse or to give a special surrender value or special benefit or annuity in event the insured or annuitant becomes totally and permanently disabled, as defined by the contract or supplemental contract;
C. group or blanket health insurance, except as stated in N.M. Stat. Ann. Chapter 59A, Article 23; or
D. reinsurance.
