A. Legal process shall be served upon a domestic reciprocal insurer by serving the insurer’s attorney at his principal office or by serving the superintendent as the insurer’s process agent under Sections 98 and 99 N.M. Stat. Ann. § 59A-5-31 and 59A-5-32 of the Insurance Code.

Terms Used In New Mexico Statutes 59A-39-13

  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Service of process: The service of writs or summonses to the appropriate party.

B. Any judgment based upon legal process so served shall be binding upon each of the insurer’s subscribers as their respective interests may appear, but in an amount not exceeding their respective contingent liabilities, if any, the same as though personal service of process was had upon each such subscriber.
