All employees and positions in the department, except for the positions of secretary and division directors and other positions expressly permitted to be exempt by the Personnel Act [N.M. Stat. Ann. Chapter 10, Article 9], shall be covered by and shall be subject to the provisions of the Personnel Act. The secretary is the appointing authority.
