§ 399-zzzz. Prohibition of certain fee charges for termination or early cancellation. 1. Subject to federal law and regulation:
Terms Used In N.Y. General Business Law 399-ZZZZ
- Contract: A legal written agreement that becomes binding when signed.
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Personal property: All property that is not real property.
a. no provider of telephone, cellular telephone, television, internet, energy, or water services shall impose a fee for termination or early cancellation of a service contract in the event the customer has deceased before the end of such contract; and
b. a retail lessee, as defined in § 331 of the personal property law, shall not be liable for charges for the early termination of a retail lease agreement of a motor vehicle if he or she has deceased before the end of such lease.
2. Every violation of this section shall be punishable by a civil penalty not to exceed one thousand dollars.
