N.Y. Public Health Law 2994-EE – Obligation to honor a nonhospital order not to resuscitate
§ 2994-ee. Obligation to honor a nonhospital order not to resuscitate. Emergency medical services personnel, home care services agency personnel, hospice personnel, or hospital emergency services personnel who are provided with a nonhospital order not to resuscitate, or who identify the standard bracelet on the patient's body, shall comply with the terms of such order; provided, however, that:

- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
1. Emergency medical services personnel, home care services agency personnel, hospice personnel, or hospital emergency services personnel may disregard the order if:
(a) They believe in good faith that consent to the order has been revoked, or that the order has been cancelled; or
(b) Family members or others on the scene, excluding such personnel, object to the order and physical confrontation appears likely; and
2. Hospital emergency services physicians and hospital emergency services nurse practitioners and physician assistants may direct that the order be disregarded if other significant and exceptional medical circumstances warrant disregarding the order.
