§ 3223. Enforcement. 1. The commissioner may conduct scheduled or unscheduled inspections of facilities where certified activities are being conducted.

2. The commissioner may suspend a certificate on the ground that the holder unreasonably refused to admit a department inspector to the premises where a recombinant DNA activity was taking place, or for any other violation of a regulation promulgated pursuant to this article. The commissioner shall hold a hearing within fifteen days following any such suspension to determine whether the suspension was reasonable. The commissioner may then annul the suspension, or if he finds the suspension to have been reasonable he may revoke the certificate or continue its suspension for a period not to exceed three months.
