§ 17-a. Limited English proficiency. 1. In accordance with § 202-a of the executive law, the board shall provide translation of (a) all documents and forms published by the board that injured employees complete; (b) all board documents that provide general information to injured employees on the process of applying for workers' compensation benefits; and (c) all other vital documents as defined by subdivision five of § 202-a of the executive law relevant to services offered by the agency.

2. The board shall provide interpretation services to injured employees with respect to its provision of services, information and/or benefits.

3. The board shall:

(a) develop a language access plan pursuant to subdivision three of § 202-a of the executive law and submit such plan to the office of general services;

(b) publish the board's language access plan on the board's website; and

(c) designate a language access coordinator who will work with the office of general services to ensure compliance with the requirements of this § -a of the executive law.

4. The language access coordinator for the board shall monitor the board's compliance with this section by annually collecting data on the provision of language assistance services, the availability of translated materials, whether signage is properly posted, and any other relevant measures.
