Terms Used In North Carolina General Statutes 106-202.20
- Conviction: A judgement of guilt against a criminal defendant.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Plant: means any member of the plant kingdom, including seeds, roots and other parts or their propagules. See North Carolina General Statutes 106-202.12
Upon conviction of any defendant for a violation of N.C. Gen. Stat. § 106-202.19, the court, in its discretion, may order the defendant to forfeit any plant or plant parts which he possesses in violation of N.C. Gen. Stat. § 106-202.19 The court shall direct disposition of any forfeited plant or plant part by destruction or sale. The clear proceeds of forfeitures and sales pursuant to this section shall be remitted to the Civil Penalty and Forfeiture Fund in accordance with N.C. Gen. Stat. § 115C-457.2 (1989, c. 508, s. 3; 1997-261, s. 109; 1998-215, s. 10.)
