Terms Used In North Carolina General Statutes 110-136.11

  • Dependent: A person dependent for support upon another.
  • IV-D case: means a case in which services have been applied for or are being provided by a child support enforcement agency established pursuant to Title IV-D of the Social Security Act as amended and this Article. See North Carolina General Statutes 110-129

(a) Notice Required. – The National Medical Support Notice shall be used to notify employers and health insurers or health care plan administrators of an order entered pursuant to N.C. Gen. Stat. § 50-13.11 for dependent health benefit plan coverage in a IV-D case. For purposes of this section and N.C. Gen. Stat. § 110-136.12 through N.C. Gen. Stat. § 110-136.14, the terms “health benefit plan” and “health insurer” are as defined in N.C. Gen. Stat. § 108A-69(a).

(b) Exception. – The National Medical Support Notice shall not be used in cases where the court has ordered nonemployment-based health benefit plan coverage or where the parties have stipulated to nonemployment-based health benefit plan coverage. (2001-237, s. 8.)
