Terms Used In North Carolina General Statutes 116B-4
- Decedent: A deceased person.
- Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
- property: shall include all property, both real and personal. See North Carolina General Statutes 12-3
Any escheated property or proceeds from the sale of escheated property held by the Escheat Fund pursuant to N.C. Gen. Stat. § 116B-5 may be claimed by an heir of the decedent or by a creditor of the decedent who is not barred from presenting a claim under the provisions of Article 19 of Chapter 28A of the N.C. Gen. Stat.. The provisions of N.C. Gen. Stat. § 116B-67(a), (c), (d), and (e) and N.C. Gen. Stat. § 116B-68 shall apply to a claim under this section.
