(a) Creation. – The Utility-Scale Solar Management Fund is created as a special fund within the Department. The Fund consists of revenue credited to the Fund from the proceeds of the fee imposed on owners of utility-scale solar projects under N.C. Gen. Stat. § 130A-309.240

(b) Use and Distribution. – Moneys in the Fund shall be used by the Department to implement the provisions of this Part concerning proper decommissioning of utility-scale solar projects. (2023-58, s. 2(a).)
