Terms Used In North Carolina General Statutes 136-28.5

  • Contract: A legal written agreement that becomes binding when signed.

(a) Diaries kept in connection with construction or repair contracts entered into pursuant to N.C. Gen. Stat. § 136-28.1 shall not be considered public records for the purposes of Chapter 132 of the N.C. Gen. Stat. until the final estimate has been paid.

(b) Analyses generated by the Department of Transportation’s Bid Analysis and Management System, including work papers, documents and the output of automated systems associated with the analyses of bids made by the Bid Analysis and Management System, are confidential and are not subject to the public records provisions of Chapter 132 of the N.C. Gen. Stat..

(c) Notwithstanding N.C. Gen. Stat. § 132-1, bids and documents submitted in response to an advertisement or request for proposal under this Chapter shall not be public record until the Department issues a decision to award or not to award the contract.
