Terms Used In North Carolina General Statutes 32C-2-219
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
(a) Except as provided in subsection (b) of this section, an agent under a power of attorney that does not expressly grant the agent the authority to do an act described in N.C. Gen. Stat. § 32C-2-201(a) may petition the court for authority to do the act described in N.C. Gen. Stat. § 32C-2-201(a) that is reasonable under the circumstances.
(b) This section shall not apply to the authority of an agent to make a gift pursuant to N.C. Gen. Stat. § 32C-2-218. (2017-153, s. 1.)
