Terms Used In North Carolina General Statutes 35A-1208
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
(a) A guardian of the person or general guardian of an incompetent adult may petition the Clerk, in accordance with N.C. Gen. Stat. § 32A-22(a), for an order suspending the authority of a health care agent, as that term is defined in N.C. Gen. Stat. § 32A-16(2).
(b) A guardian of the person or general guardian of an incompetent adult may not revoke a Declaration, as that term is defined in N.C. Gen. Stat. § 90-321 (2007-502, s. 8.)
