The following definitions apply in this Chapter:

(1) Human trafficking offense. – Any criminal offense under Article 10A of Chapter 14 of the N.C. Gen. Stat. that is not a sex offense.

Terms Used In North Carolina General Statutes 50D-1

  • following: when used by way of reference to any section of a statute, shall be construed to mean the section next preceding or next following that in which such reference is made; unless when some other section is expressly designated in such reference. See North Carolina General Statutes 12-3
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.

(1a) Permanent civil no-contact order. – A permanent injunction that prohibits any contact by a respondent with the victim of a human trafficking offense or sex offense for which the respondent is convicted.

(2) Respondent. – The person who committed the human trafficking offense or sex offense.

(3) Sex offense. — Any criminal offense that requires registration under Article 27A of Chapter 14 of the N.C. Gen. Stat..

(4) Victim. – The person against whom the human trafficking offense or sex offense was committed. (2015-91, s. 1; 2023-71, s. 1(a).)
