The insurer against which a request for a standard external review or an expedited external review is filed shall reimburse the Department of Insurance for the fees charged by the organization in conducting the external review, including work actually performed by the organization for a case that was terminated due to the insurer’s decision to reconsider a request and reverse its noncertification decision, prior to the insurer notifying the organization of the reversal pursuant to N.C. Gen. Stat. § 58-50-80(j), or when a review is terminated pursuant to N.C. Gen. Stat. § 58-50-80(h) because the insurer failed to provide information to the review organization. (2001-446, s. 4.5.)
