(a) An operator to whom a notice or order is issued under N.C. Gen. Stat. § 74-24.8 and N.C. Gen. Stat. § 74-24.9 may contest the notice or order by filing a petition for a contested case under N.C. Gen. Stat. § 150B-23 within 30 days after receiving the notice or order.  An operator who files a petition for a contested case shall send a copy of the petition to all affected miners or to their representative, if any, when the petition is filed.  Judicial review of a decision by the Commissioner in a contested case is available under Article 4 of Chapter 150B of the N.C. Gen. Stat..

(b) A notice or order, except an order issued under N.C. Gen. Stat. § 74-24.8(a), shall be stayed while it is under administrative or judicial review. (1975, c. 206, s. 10; 1987, c. 827, s. 259.)
