- bid: means a written or oral offer or proposal by an exhibitor to a distributor, in response to an invitation to bid for the right to exhibit a motion picture, stating the terms under which the exhibitor will agree to exhibit a motion picture. See North Carolina General Statutes 75C-2
- Commission: means the North Carolina State Lottery Commission. See North Carolina General Statutes 18C-103
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Director: means the person selected by the Commission to be the chief administrator of the North Carolina State Lottery. See North Carolina General Statutes 18C-103
- distributor: means any person engaged in the business of distributing or supplying motion pictures to exhibitors by rental or licensing. See North Carolina General Statutes 75C-2
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- exhibition: means showing a motion picture to the public for a charge. See North Carolina General Statutes 75C-2
- exhibitor: means any person engaged in the business of operating one or more theatres. See North Carolina General Statutes 75C-2
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- following: when used by way of reference to any section of a statute, shall be construed to mean the section next preceding or next following that in which such reference is made; unless when some other section is expressly designated in such reference. See North Carolina General Statutes 12-3
- in writing: may be construed to include printing, engraving, lithographing, and any other mode of representing words and letters: Provided, that in all cases where a written signature is required by law, the same shall be in a proper handwriting, or in a proper mark. See North Carolina General Statutes 12-3
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- invitation to bid: means a written or oral solicitation or invitation by a distributor to one or more exhibitors to bid or negotiate for the right to exhibit a first run motion picture. See North Carolina General Statutes 75C-2
- license agreement: means any contract, agreement, understanding or condition between a distributor and an exhibitor relating to the licensing or exhibition of a motion picture by the exhibitor. See North Carolina General Statutes 75C-2
- Lottery: means any lottery game or series of games established and operated pursuant to this Chapter. See North Carolina General Statutes 18C-103
- lottery game: means any procedure or amusement authorized by the Commission where prizes are distributed among persons who have paid, or unconditionally agreed to pay, for tickets or shares that provide the opportunity to win those prizes and does not utilize a video gaming machine as defined in N. See North Carolina General Statutes 18C-103
- person: includes one or more individuals, partnerships, associations, societies, trusts, or corporations. See North Carolina General Statutes 75C-2
- run: means the continuous exhibition of a motion picture in a defined geographic area for a specified period of time. See North Carolina General Statutes 75C-2
- state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall be construed to include the said district and territories and all dependencies. See North Carolina General Statutes 12-3
- trade screening: means the showing of a motion picture by a distributor within the State which is open to any exhibitor interested in exhibiting the motion picture. See North Carolina General Statutes 75C-2
