1. A person that is a business entity may be prosecuted for an offense under section 12.1-41-02 through 12.1-41-06 as provided by chapter 12.1-03.
Terms Used In North Dakota Code 12.1-41-07
- Court: means any of the following courts: the supreme court, a district court, and where relevant, a municipal court. See North Dakota Code 12.1-01-04
- Government: means :

- Local: means of or pertaining to any political subdivision of the state. See North Dakota Code 12.1-01-04
- Offense: means conduct for which a term of imprisonment or a fine is authorized by statute after conviction. See North Dakota Code 12.1-01-04
- person: includes , where relevant, a corporation, limited liability company, partnership, unincorporated association, or other legal entity. See North Dakota Code 12.1-01-04
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See North Dakota Code 1-01-49
2. When a person that is a business entity is prosecuted for an offense under section 12.1-41-02 through 12.1-41-06, the court may consider the severity of the entity’s conduct and order penalties in addition to those otherwise provided for the offense, including:
a. A fine of not more than one million dollars per offense; b. Disgorgement of profit from activity in violation of this chapter; and c. Debarment from state and local government contracts.
