In an investigation of or a prosecution for an offense under this chapter, a law enforcement agency and state‘s attorney shall keep confidential the identity, pictures, and images of the alleged victim and the family of the alleged victim, except to the extent that disclosure is:
Terms Used In North Dakota Code 12.1-41-10
- Court: means any of the following courts: the supreme court, a district court, and where relevant, a municipal court. See North Dakota Code 12.1-01-04
- Offense: means conduct for which a term of imprisonment or a fine is authorized by statute after conviction. See North Dakota Code 12.1-01-04
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See North Dakota Code 1-01-49
1. Necessary for the purpose of investigation or prosecution; 2. Required by law or court order; or
3. Necessary to ensure provision of services or benefits for the victim or the victim’s family.
