1.    In a proceeding under sections 14-20-36 through 14-20-58, the court shall issue a temporary order for support of a child if the order is appropriate and the individual ordered to pay support is:

Terms Used In North Dakota Code 14-20-51

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Individual: means a human being. See North Dakota Code 1-01-49
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See North Dakota Code 1-01-49

a.    A presumed father of the child; b.    Petitioning to have his paternity adjudicated; c.    Identified as the father through genetic testing under section 14-20-29; d.    An alleged father who has declined to submit to genetic testing; e.    Shown by clear and convincing evidence to be the father of the child; or f.    The mother of the child.

2.    A temporary order may include provisions for custody and visitation as provided by other law of this state.
