A redemptioner shall produce to the officer or person from whom the redemptioner seeks to redeem and shall serve with the redemptioner’s notice to the sheriff:

Terms Used In North Dakota Code 28-24-05

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Docket: A log containing brief entries of court proceedings.
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Person: means an individual, organization, government, political subdivision, or government agency or instrumentality. See North Dakota Code 1-01-49
  • Verified: means sworn to before an officer authorized to administer oaths. See North Dakota Code 1-01-42

1.    A copy of the docket of the judgment under which the redemptioner claims the right to redeem, certified by the clerk of the district court of the county where the judgment is docketed, or, if the redemptioner redeems upon a mortgage or other lien, a note of the record of the mortgage or lien certified by the county recorder; 2.    A copy of the assignment necessary to establish the redemptioner’s claim, verified by the affidavit of the redemptioner or of a subscribing witness to the assignment; and

     3.    An affidavit by the redemptioner or the redemptioner’s agent showing the amount then actually due on the lien.
