A proprietary employer is a person who employs an individual to provide security for that person’s own property or protection. A proprietary employer is not required to be licensed as a private security service if the employer does not offer or provide security services to others.
Terms Used In North Dakota Code 43-30-02.2
- Individual: means a human being. See North Dakota Code 1-01-49
- Person: means an individual, organization, government, political subdivision, or government agency or instrumentality. See North Dakota Code 1-01-49
- Property: includes property, real and personal. See North Dakota Code 1-01-49
Proprietary security employees may be voluntarily registered as security officers under section 43-30-06. In order to be registered as a proprietary security officer, an employee must meet all of the requirements to be registered as a security officer except for:
1. Employment by a licensed private security service; and
2. Supervision by an individual who is licensed to provide security services.
