North Dakota Code 50-11-02.3 – Moratorium on expansion of residential child care facility or group home bed capacity
(Effective through September 30, 2019) Notwithstanding sections 50-11-02 and 50-11-09, unless a needs assessment conducted by the department indicates a need for the licensing of additional bed capacity, the department may not issue a license under this chapter for any additional bed capacity for a residential child care facility or a group home above the state‘s gross number of beds licensed as of June 30, 2003.

Maximum qualified residential treatment program bed capacity. (Effective after September 30, 2019) Notwithstanding sections 50-11-02 and 50-11-09, the department shall determine the maximum number of licensed qualified residential treatment program bed capacity for children based upon a needs assessment conducted by the department.
