North Dakota Code 54-52-02.11 – Participation requirements for nonstate elected officials
(Effective through December 31, 2023, or December 31, 2024 – See note) Elected officials of participating counties, at their individual option, may enroll in the defined benefit plan within the first six months of their term.

- Individual: means a human being. See North Dakota Code 1-01-49
Participation requirements for nonstate elected officials. (Effective after December 31, 2023, contingent effective date – See note) 1. Before January 1, 2024, eligible elected officials of participating counties, at their individual option, may enroll in the defined benefit plan within the first six months of their term.
2. After December 31, 2023, eligible elected officials of participating counties, at their individual option, may enroll in the defined contribution retirement plan under chapter 54-52.6 within the first six months of their term.
