§ 79.03 Application.
Terms Used In N.Y. Mental Hygiene Law 79.03
- administration: means the United States veterans' administration or its successor. See N.Y. Mental Hygiene Law 79.01
- benefits: shall mean all moneys payable by the United States through the administration. See N.Y. Mental Hygiene Law 79.01
- director: means the director of the United States veterans' administration or his successor. See N.Y. Mental Hygiene Law 79.01
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- ward: means a beneficiary of the administration. See N.Y. Mental Hygiene Law 79.01
Whenever, pursuant to any law of the United States or regulation of the administration, the director requires, prior to payment of benefits, that a guardian be appointed for a ward, such appointment shall be made in the manner hereinafter provided. The provisions of this Article of the administration and with respect to such wards, except as herein otherwise specifically provided, shall supersede any inconsistent provision of law relating to incompetents, conservatees or infants.
