§ 467. Single use tattoo and body piercing equipment.
Terms Used In N.Y. Public Health Law 467
- Body piercing: shall mean the piercing of any part of the body, except the ear. See N.Y. Public Health Law 460
- Body piercing specialist: shall mean any person who performs body piercing on the body of any other person. See N.Y. Public Health Law 460
- Body piercing studio: shall mean any premises in which the body piercing specialist conducts such practice. See N.Y. Public Health Law 460
- Commissioner: shall mean the commissioner of health. See N.Y. Public Health Law 460
- Tattoo: shall mean a mark on the body of a person made with indelible ink or pigments injected beneath the outer layer of the skin. See N.Y. Public Health Law 460
- Tattoo studio: shall mean any premises in which the tattooist conducts such practice. See N.Y. Public Health Law 460
- Tattooist: shall mean any person who applies a tattoo to the body of any other person. See N.Y. Public Health Law 460
1. All tattoo studios and body piercing studios shall use only single use needles and approved ink handling procedures in all tattoo and body piercing procedures performed in such establishments.
2. Prior to a person receiving a tattoo or body piercing from a licensed tattooist or body piercing specialist, such person and licensed tattooist or body piercing specialist must sign a form confirming that the tattooist or body piercing specialist:
(a) Presented all single use needles in a sterile and sealed package, that are to be used during the tattoo or body piercing procedure, to the person receiving such tattoo or body piercing, and explained that only approved ink handling procedures would be used; and
(b) Opened all single use needles that are to be used during the tattoo or body piercing procedure in the presence of the person receiving such tattoo or body piercing.
3. A copy of the confirmation form shall be given to the person receiving a tattoo or body piercing. The tattoo studio or body piercing studio shall retain a copy of such confirmation form for a period not less than seven years.
4. The commissioner shall make regulations under this section.
