Terms Used In Oregon Statutes 183.338

  • Agency: means any state board, commission, department, or division thereof, or officer authorized by law to make rules or to issue orders, except those in the legislative and judicial branches. See Oregon Statutes 183.310
  • Rule: means any agency directive, standard, regulation or statement of general applicability that implements, interprets or prescribes law or policy, or describes the procedure or practice requirements of any agency. See Oregon Statutes 183.310
  • state government: means the executive department, the judicial department and the legislative department. See Oregon Statutes 174.111
  • United States: includes territories, outlying possessions and the District of Columbia. See Oregon Statutes 174.100

(a) ‘Noncitizen’ means an individual who is not a citizen or national of the United States.

(b) ‘State agency‘ means any state officer, board, commission, department, division, institution, branch or agency of the state government.

(2) A state agency shall use the term ‘noncitizen’ to reference an individual who is not a citizen or national of the United States when promulgating a rule or regulation that references an individual who is not a citizen or national of the United States. [2022 c.97 § 1]

 

183.338 was enacted into law by the Legislative Assembly but was not added to or made a part of ORS Chapter 183 or any series therein by legislative action. See Preface to Oregon Revised Statutes for further explanation.
