(1) In each election, an elector has the right to cast the elector’s ballot in a confidential manner, with no other person knowing how the elector voted in the election.
Terms Used In Oregon Statutes 254.400
- ballot: includes material posted in a voting compartment or delivered to an elector by mail. See Oregon Statutes 254.005
- County clerk: means the county clerk or the county official in charge of elections. See Oregon Statutes 254.005
- Elector: means an individual qualified to vote under section 2, Article II, Oregon Constitution. See Oregon Statutes 254.005
- Person: includes individuals, corporations, associations, firms, partnerships, limited liability companies and joint stock companies. See Oregon Statutes 174.100
(2)(a) The Secretary of State or county clerk may not disclose as a public record under ORS § 192.311 to 192.478 any information that would reveal how a particular elector voted in an election.
(b) As used in this subsection, ‘information’ may be defined by the secretary by rule. [2023 c.600 § 3]
