(1) Notwithstanding ORS § 270.010 (2) or 270.100 to 270.190, a state agency may transfer, convey, donate, exchange or lease to an eligible Indian tribe, as defined in ORS § 307.181, any real property or interest in real property owned by the agency at such price and on such terms as the agency may determine.

  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.

(2) Notwithstanding ORS § 273.775 to 273.790, an agency disposing of real property or interest in real property under this section also may convey the mineral and geothermal resource rights in the real property to the Indian tribe. [2023 c.415 § 1]
