Any witness subpoenaed or whose deposition is taken shall receive the fees and mileage provided for witnesses in ORS § 44.415 (2). Witnesses for the state or its political subdivisions shall be paid from moneys appropriated therefor. Payment of fees and mileage to other witnesses shall be made by the party at whose instance the witness appears or the deposition is taken. [Formerly 305.495]
