Any check or warrant issued by the Department of Human Services or the Oregon Health Authority to a recipient of public assistance or medical assistance who subsequently dies may be indorsed in the name of the deceased by the surviving spouse or a next of kin in the order described in ORS § 293.490 (3); and payment may be made and the proceeds used without any of the restrictions enumerated in ORS § 293.495 (1).
