Oregon Statutes 414.337 – Limitation on rules regarding Practitioner-Managed Prescription Drug Plan
The Oregon Health Authority may not adopt or amend any rule that requires a prescribing practitioner to contact the authority to request an exception for a medically appropriate or medically necessary drug that is not listed on the Practitioner-Managed Prescription Drug Plan drug list for that class of drugs adopted under ORS § 414.334, unless otherwise authorized by enabling legislation setting forth the requirement for prior authorization. Terms Used In Oregon Statutes 414.337
- Medical assistance: includes any care or services for any individual who is a patient in a medical institution or any care or services for any individual who has attained 65 years of age or is under 22 years of age, and who is a patient in a private or public institution for mental diseases. See Oregon Statutes 414.025
- Mental health drug: means a type of legend drug, as defined in ORS § 414. See Oregon Statutes 414.025
414.337 was enacted into law by the Legislative Assembly but was not added to or made a part of ORS Chapter 414 or any series therein by legislative action. See Preface to Oregon Revised Statutes for further explanation.
Sections 3 and 4, chapter 544, Oregon Laws 2019, provide:
(1) As used in this section, ‘mental health drug’ means a type of legend drug defined by the Oregon Health Authority by rule that includes but is not limited to:
(a) Therapeutic class 7 ataractics-tranquilizers; and
(b) Therapeutic class 11 psychostimulants-antidepressants.
(2) Notwithstanding ORS § 414.334, the authority shall reimburse the cost of a mental health drug prescribed for a medical assistance recipient if federal financial participation in the cost is available. [2019 c.544 § 3]
