(1) A person or organization that makes a referral or recommendation related to the use of a secure transportation services provider to transport a child to a child-caring agency, certified foster home or developmental disabilities residential facility must provide the written disclosure described in subsection (2) of this section if the child to be transported is a resident of this state or if the child-caring agency, certified foster home or developmental disabilities residential facility to which the secure transportation services provider will deliver the child is located in this state.

(2) The disclosure under this section must state:

Except as specifically exempted under ORS § 418.241, a secure transportation services provider that transports children to or from a child-caring agency, certified foster home or developmental disabilities residential facility along any portion of a route that begins or ends in Oregon is required to be licensed by the Department of Human Services under ORS § 418.215 or 418.240.

(3) As used in this section, ‘certified foster home,’ ‘child-caring agency,’ ‘developmental disabilities residential facility’ and ‘secure transportation services’ have the meanings given those terms in ORS § 418.241. [2021 c.672 § 14; 2022 c.90 § 16]
