(1) Whenever an adjudicated youth has been found to be within the jurisdiction of the court under ORS § 419C.005 (1) for having committed an act from which it appears that the transmission of body fluids from one person to another as described in ORS § 135.139 may have been involved or a sexual act may have occurred, the court shall order the adjudicated youth to submit to blood-borne infection testing as provided in ORS § 135.139 if the victim, or parent or guardian of the victim, requests the court to make such an order.

Terms Used In Oregon Statutes 419C.475

  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Person: includes individuals, corporations, associations, firms, partnerships, limited liability companies and joint stock companies. See Oregon Statutes 174.100
