(1) The Environmental Quality Commission shall establish by rule an annual fee, which must be reasonably calculated to cover the costs to the Department of Environmental Quality of implementing, administering and enforcing ORS § 459A.305 to 459A.355.

(2) The commission shall establish by rule a one-time plan review fee reasonably calculated to cover the costs to the department of reviewing the initial electronics producer responsibility program plan submitted to the department for approval under ORS § 459A.321 by each electronics producer responsibility organization. The department may not approve an initial plan under ORS § 459A.321 if the electronics producer responsibility organization has not paid the fee required by this subsection. [2023 c.259 § 8]

 

459A.334 becomes operative January 1, 2026, and applies to electronics producer responsibility program plans submitted to the Department of Environmental Quality pursuant to section 21, chapter 259, Oregon Laws 2023. See sections 20 and 21, chapter 259, Oregon Laws 2023.
