In accordance with the purposes of ORS § 465.425 to 465.455, the Environmental Quality Commission by rule shall define the instances in which a person acting under ORS Chapter 709 and in a fiduciary capacity shall be exempt from liability for environmental contamination at property the fiduciary holds in a fiduciary capacity. In adopting the rules, the commission shall consider and, to the extent appropriate, provide exemptions from liability for the fiduciaries that are similar in purpose and effect to those exemptions provided for security interest holders under rules adopted under ORS § 465.435.
