Commercial weighing or measuring instruments or devices specified in ORS § 618.141 are exempt from the licensing requirements in ORS § 618.121 if any of the following apply:

Terms Used In Oregon Statutes 618.126

  • local government: means all cities, counties and local service districts located in this state, and all administrative subdivisions of those cities, counties and local service districts. See Oregon Statutes 174.116
  • Weights and measures: means all weights and measures, instruments and devices of every kind for weighing and measuring, and any appliances and accessories associated with any or all such instruments and devices. See Oregon Statutes 618.010

(1) Ownership and use of the instrument or device is limited to federal, state or local government agencies in the performance of official functions.

(2) The instrument or device is of a readily portable type, not intended for use within the state in excess of 30 days annually, and for which proof exists of satisfactory examination within the immediately preceding six months by a state or local weights and measures authority.
