Representatives designated or selected for the purposes of collective bargaining, by the majority of the employees in a unit appropriate for such purposes, are the exclusive representatives of all the employees in that unit for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment or other conditions of employment. However, an individual employee or a group of employees may at any time present grievances to their employer and have such grievances adjusted, without the intervention of the bargaining representative, if:

Terms Used In Oregon Statutes 663.015

  • Contract: A legal written agreement that becomes binding when signed.
  • Employee: includes any employee, and is not limited to the employees of a particular employer unless this chapter explicitly states otherwise, and includes any individual whose work has ceased as a consequence of, or in connection with, a current labor dispute and who has not obtained any other regular and substantially equivalent employment, but does not include an individual:

    (a) Employed in agricultural labor as defined in ORS § 657. See Oregon Statutes 663.005

  • Employer: includes any person acting as an agent of an employer, directly or indirectly, but does not include:

    (a) The United States or any wholly owned government corporation, or any Federal Reserve Bank. See Oregon Statutes 663.005

  • Representative: includes an individual or labor organization. See Oregon Statutes 663.005

(1) The adjustment is not inconsistent with the terms of a collective-bargaining contract or agreement then in effect; and

(2) The bargaining representative has been given opportunity to be present at the adjustment. [Formerly 662.525]
