(1) A ‘person in the position of a seller‘ includes as against a principal an agent who has paid or become responsible for the price of goods on behalf of the principal or anyone who otherwise holds a security interest or other right in goods similar to that of a seller.
Terms Used In Oregon Statutes 72.7070
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Person: includes individuals, corporations, associations, firms, partnerships, limited liability companies and joint stock companies. See Oregon Statutes 174.100
- Seller: means a person who sells or contracts to sell goods. See Oregon Statutes 72.1030
(2) A person in the position of a seller may as provided in ORS § 72.7050 withhold or stop delivery and resell as provided in ORS § 72.7060 and recover incidental damages as provided in ORS § 72.7100. [1961 c.726 § 72.7070]
