(1) Except as provided in ORS § 94.570, a person may not create a planned community in this state except as provided in ORS § 94.550 to 94.783.

- Person: includes individuals, corporations, associations, firms, partnerships, limited liability companies and joint stock companies. See Oregon Statutes 174.100
(2) A person may not convey any lot or unit in a planned community until the planned community is created by the recording of the declaration for the planned community with the county recording officer of each county in which the planned community is located.
