Terms Used In Oregon Statutes > Chapter 342 - Teachers and Other School Personnel
- Administrative license: means a license issued under ORS § 342. See Oregon Statutes 342.120
- Administrator: includes but is not limited to all superintendents, assistant superintendents, principals and academic program directors in public schools or education service districts who have direct responsibility for supervision or evaluation of licensed teachers and who are compensated for their services from public funds. See Oregon Statutes 342.120
- Allegation: something that someone says happened.
- Appraisal: A determination of property value.
- Approved educator preparation program: means a licensure program that:
(a) Prepares persons to become educators in any grade from preprimary through grade 12;
(b) Is offered by an approved educator preparation provider; and
(c) Meets the standards of the Teacher Standards and Practices Commission, as provided by ORS § 342. See Oregon Statutes 342.120
- Approved educator preparation provider: means a sponsor or provider of an educator preparation program that meets the standards of the Teacher Standards and Practices Commission, as provided by ORS § 342. See Oregon Statutes 342.120
- Articles of incorporation: means the articles described in ORS § 60. See Oregon Statutes 60.001
- Board: means the Construction Contractors Board. See Oregon Statutes 701.005
- Commission licensee: means a person whom the Teacher Standards and Practices Commission has the authority to investigate or discipline because the person:
(a) Is enrolled in an approved educator preparation program;
(b) Is an applicant for a Teacher Standards and Practices Commission license or registration;
(c) Holds a license or registration issued by the Teacher Standards and Practices Commission; or
(d) Has held a license or registration issued by the Teacher Standards and Practices Commission at any time during the previous five years. See Oregon Statutes 342.120
- Contractor: means any of the following:
(a) A person that, for compensation or with the intent to sell, arranges or undertakes or offers to undertake or submits a bid to construct, alter, repair, add to, subtract from, improve, inspect, move, wreck or demolish, for another, a building, highway, road, railroad, excavation or other structure, project, development or improvement attached to real estate, or to do any part thereof. See Oregon Statutes 701.005
- Executive session: A portion of the Senate's daily session in which it considers executive business.
- Gender identity: means an individual's gender-related identity, appearance, expression or behavior, regardless of whether the identity, appearance, expression or behavior differs from that associated with the gender assigned to the individual at birth. See Oregon Statutes 174.100
- General contractor: means a contractor whose business operations require the use of more than two unrelated building trades or crafts that the contractor supervises or performs in whole or part, whenever the sum of all contracts on any single property, including materials and labor, exceeds an amount established by rule by the board. See Oregon Statutes 701.005
- Grantor: The person who establishes a trust and places property into it.
- Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
- Home inspector: means a person who, for a fee, inspects and provides written reports on the overall physical condition of a residential structure. See Oregon Statutes 701.005
- Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
- Instructional assistant: means a classified school employee who does not require a license to teach, who is employed by a school district or education service district and whose assignment consists of and is limited to assisting a licensed teacher in accordance with rules established by the Teacher Standards and Practices Commission. See Oregon Statutes 342.120
- Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
- Legacy: A gift of property made by will.
- local government: means all cities, counties and local service districts located in this state, and all administrative subdivisions of those cities, counties and local service districts. See Oregon Statutes 174.116
- Officer: means any of the following persons:
(a) A president, vice president, secretary, treasurer or director of a corporation. See Oregon Statutes 701.005
- Proceeding: means a civil, criminal, administrative or investigatory action. See Oregon Statutes 60.001
- Public defender: Represent defendants who can't afford an attorney in criminal matters.
- Responsible managing individual: means an individual who:
(a) Is an owner described in ORS § 701. See Oregon Statutes 701.005
- Right of survivorship: The ownership rights that result in the acquisition of title to property by reason of having survived other co-owners.
- Sexual orientation: means an individual's actual or perceived heterosexuality, homosexuality or bisexuality. See Oregon Statutes 174.100
- Share: means a unit into which the proprietary interest in a corporation is divided. See Oregon Statutes 60.001
- Shareholder: means a person in whose name a share is registered in the records of a corporation or the beneficial owner of a share to the extent of the rights granted by a nominee certificate on file with a corporation. See Oregon Statutes 60.001
- Specialty contractor: includes a person who performs work regulated under ORS § 446. See Oregon Statutes 701.005
- state government: means the executive department, the judicial department and the legislative department. See Oregon Statutes 174.111
- Teacher: includes all licensed employees in the public schools or employed by an education service district who have direct responsibility for instruction or coordination of educational programs and who are compensated for their services from public funds. See Oregon Statutes 342.120
- Teaching license: means a license issued under ORS § 342. See Oregon Statutes 342.120
- Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
- Uphold: The decision of an appellate court not to reverse a lower court decision.
- Voting group: means all shares of one or more classes or series that under the articles of incorporation or this chapter are entitled to vote and be counted together collectively on a matter at a meeting of shareholders. See Oregon Statutes 60.001
- Worker leasing company: means a person licensed under ORS § 656. See Oregon Statutes 701.005
